The latest proposals in the Online Safety Bill to make me criminally responsible for any harmful content which anyone posts on Templot Club are very worrying. Clearly a web site about model railways is likely to fall into the official category of sites likely to be found by children.

The likelihood of any member of Templot Club posting anything harmful must be vanishingly small, but that doesn't make it impossible.

New memberships are approved by me, and I see almost everything posted here, but I can't guarantee to oversee 100% of the content. If I was taken ill for example, I might be away from the site for weeks.

Hi Martin,

The way I read it is that it would be the owners of Xenforo that would be criminally responsible, and even then only if they refuse to hand over information to Ofcom, although it’s not clear from the sloppily written BBC article.

This is one of many concerning bills and proposals from the government at the moment.

Hopefully, amongst the membership, there may be a legal eagle, that could shed some light on the situation, especially if it reaches the statute book.

Hi Paul,

Although XenForo Ltd do offer a hosting service for their software, Templot Club isn't using it. This XenForo software is purchased by me and running on my web space. XenForo Ltd have no access to the files or the database.

The hosting provider for the web space obviously do own and have access to the server, and any illegal or harmful content which I allow to be uploaded to their server would be an infringement of their terms and conditions. If they became legally liable in some way as a result, I'm fairly sure this site would get closed down instantly and they would be coming to me for damages.

But the person with actual day-to-day control of the contents of this site and ownership of the domain name is me. I doubt the law would allow me to escape from that by shifting responsibility to the hosting provider, or anyone else.

Otherwise the big social media sites would do exactly the same, and it would turn out that their servers are actually owned by some unknown company registered on the moon!

For now it's wait and see. I shall be watching what other modelling and hobby forums do about it.

An obvious first step might be to make Templot Club a closed private forum accessible only to registered members. Which would be a shame, because among other things it wouldn't get indexed on Google, and it wouldn't be possible to post links elsewhere to the content. And it doesn't prevent a child registering as a member -- I have no means to check the age or vulnerability of members.

One would hope that responsible members would use the "Report" link pronto to bring anything untoward to your attention.

I presume that you, Martin, are the only one who holds the 'Keys to the Kingdom' so that may be something you might wish to reflect on. A trusted deputy could be of immense help to you in the event of holidays, illness or other situation requiring prompt action.

Thanks Dave. It's something to think about. I wouldn't want a deputy to end up sharing any responsibility if things went wrong. The BBC report refers to "managers of sites hosting user-generated content".

What's so frustrating is that it's all so unlikely that we ought not need to even think about it. But the world is so turned upside-down lately that we do have to think about such things, however inconceivable. It would be heartbreaking if any harm did come to anyone as a result of visiting my web site.

For now, it's wait and see. There are lots of hobby forums in the same boat, perhaps some guidance will be forthcoming from Ofcom.
